This HubSpot Anti-Spam Policy (the "Policy") supplements HubSpot's Acceptable Use Policy and is incorporated into your Agreement. This Policy establishes HubSpot's commitment to protecting the integrity of our email infrastructure and users' communications.
By using HubSpot Services, you acknowledge that you have read, understood, and agree to comply with this Policy. HubSpot may update this Policy at https://legal.hubspot.com/anti-spam-policy, and we will notify you of material changes through your HubSpot account or email.

1. SCOPE AND APPLICATION
This Policy applies to (i) services provided by HubSpot that enable message transmission through the HubSpot platform (including email, SMS, messaging, etc.), (collectively the "HubSpot Services"), (ii) Users and their recipients, (iii) outbound communications sent directly through HubSpot Services, (iv) automated communications (including autoresponders, form confirmations, chatbot messages, etc.), and (v) all message types (i.e., marketing, transactional, and operational messages).
2. PROHIBITED SPAM PRACTICES
2.1 General Prohibition. You may not use HubSpot Services to send, facilitate, or enable spam. Spam includes but is not limited to: (i) unsolicited bulk messages sent to recipients who have not provided verifiable, explicit consent, (ii) unsolicited commercial messages or one-to-one commercial communications that violate applicable anti-spam laws, and (iii) messages sent in violation of applicable data protection regulations.
2.1.1 You are strictly prohibited from using the HubSpot Services to directly contact recipients from purchased, rented, borrowed, or other third-party lists, including email append services or enrichment services lists in violation of applicable laws or third-party terms.
3. MESSAGE REQUIREMENTS
3.1 Consent Requirements. Messages sent through HubSpot Services must be sent only to recipients who have: (i) provided express, verifiable consent to receive such communications, (ii) opted in through a clear, documented process, and (iii) not withdrawn their consent or unsubscribed.
3.1.1. Exceptions to Consent Requirements (i) Transactional Messages. Certain requirements may not apply to purely transactional messages that relate to an existing transaction or relationship, do not contain marketing content, include accurate sender information, and comply with applicable laws. (ii) Internal Communications. Communications to employees or internal stakeholders may have modified requirements based on the relationship and applicable laws.
3.2 Authentication and Headers. All messages must contain: (i) accurate "From" information, (ii) valid, functioning reply-to addresses, (iii) authentic domain information, and (iv) clear identification of the sender organization. You must properly configure SPF, DKIM, and DMARC records, maintain valid DNS records for sending domains, use only authorized IP addresses for sending, and comply with industry-standard authentication protocols.
3.3 Subject Lines and Content Integrity. Messages must not: (i) use misleading or deceptive subject lines, (ii) misrepresent the sender's identity, (iii) contain false or misleading content, or (iv) impersonate other organizations or individuals, (iv) mislead recipients about whether they are interacting with a human or automated system, or (v) fail to disclose the use of AI generated content where required by applicable law.
3.4 Unsubscribe and Opt-Out Mechanisms. Every marketing message must include: (i) a clear, conspicuous unsubscribe link or mechanism, (ii) simple, one-click unsubscribe functionality, (iii) immediate processing of unsubscribe requests within 24 hours, and (iv) confirmation that the unsubscribe was successful. You must honor all unsubscribe requests promptly, maintain and respect suppression lists, apply opt-outs across all communication channels, never require login credentials to unsubscribe, and not charge fees or impose conditions for opting out.
3.5 Volume Restrictions. HubSpot maintains sending limits to prevent abuse, including: (i) daily sending limits based on account type and history, (ii) hourly rate limits to prevent sudden volume spikes, (iii) recipient limits per message, and (iv) automatic throttling for accounts showing signs of abuse.
3.6 Quality and Engagement Standards. You must monitor and maintain: (i) bounce rates below 5%, (ii) spam complaint rates below 0.1%, (iii) engagement rates consistent with industry standards, and (iv) list hygiene through regular cleaning and validation consistent with industry standards. You are expected to: (i) remove hard bounces immediately, (ii) suppress inactive contacts after reasonable re-engagement attempts, (iii) segment lists appropriately, and (iv) send relevant, targeted content.
3.7 Telephone and SMS Compliance. When using telephone, SMS, or messaging services, you must: (i) obtain explicit written consent for automated calls or texts, (ii) comply with TCPA and similar telecommunications laws, (iii) respect time-of-day restrictions, (iv) include opt-out instructions in every message, and (v) maintain Do-Not-Call list compliance.
3.7.1 SMS-Specific Requirements. SMS messages must: (i) include sender identification, (ii) provide STOP instructions, (iii) honor STOP, QUIT, CANCEL, UNSUBSCRIBE commands, and (iv) comply with carrier guidelines and CTIA best practices.
4. MONITORING AND ENFORCEMENT
4.1 HubSpot's Monitoring Rights. HubSpot reserves the right to: (i) monitor sending patterns and content, (ii) review user lists and subscription practices, (iii) investigate complaints and suspicious activity, (iv) request documentation of consent, and (v) audit compliance with this Policy and other terms applicable to your use. We will take enforcement action for violations of this Policy, in our sole and reasonable judgment.
4.2 Reporting Violations. Suspected violations should be reported to abuse@hubspot.com and should include: (i) full message headers and relevant details, and (ii) specific violation information.
4.3 Investigation and Enforcement. HubSpot will: (i) acknowledge receipt of complaints, (ii) investigate reported violations, (iii) take appropriate action based on findings, and (iv) maintain complainant confidentiality where possible. Violations may result in warning, temporary restriction, suspension, account termination, or other remedies available under applicable law.
